1. General Provisions
All services provided by JoyTech Mechanical are governed by these Terms and Conditions. By signing a proposal for HVAC installation services, the customer agrees to be bound by all the terms listed herein.
2. Proposal Acceptance and Deposit
Upon acceptance of the proposal, an initial deposit is required to secure the project. This deposit is non-refundable following a cancellation after the proposal has been signed. Customers are advised to carefully review the proposal before signing.
3. Permits and Compliance
The customer is solely responsible for ensuring compliance with all applicable local, state, and federal laws, regulations, and building codes. This includes obtaining and paying for any required permits for electrical, HVAC, and Department of Buildings (DOB) work, unless otherwise specified in the proposal. JoyTech Mechanical shall not be liable for any issues, fines, or delays caused by the customer’s failure to obtain or comply with permit requirements.
4. Electrical Supply Requirements
The proper functioning of the heat pump system requires a 220-volt electrical supply. It is the customer’s responsibility to ensure that this electrical supply is available at the installation location. If an electrical service upgrade is required, it must be explicitly included as a separate clause in the proposal. JoyTech Mechanical shall not be responsible for delays or additional costs resulting from the absence of a suitable electrical supply.
5. Rebates and Incentives
If the customer intends to claim any rebates, tax credits, or other financial incentives related to the HVAC installation, they are solely responsible for ensuring their eligibility. If the customer is found to be ineligible for a rebate after the installation is completed, they will be responsible for the cost associated with the rebate. JoyTech Mechanical makes no guarantees regarding the customer’s eligibility for rebates or incentives.
6. Payment Terms
Payment is due in full upon completion of the installation unless an alternative payment plan has been agreed upon in writing prior to the commencement of work. Failure to remit payment as agreed may result in the suspension of warranty services and/or the pursuit of collection activities, including the placement of a mechanic’s lien on the property where the installation occurred.
7. Changes and Additional Work
Any changes to the scope of work must be agreed upon in writing and may result in additional charges. The customer will be notified of any changes in scope and associated costs before the work proceeds with an updated proposal.
8. Liability and Indemnity
JoyTech Mechanical shall not be held liable for damages resulting from the customer’s failure to comply with permit, electrical, or code requirements. The customer agrees to indemnify and hold harmless JoyTech Mechanical from any claims, fines, or damages arising from such non-compliance.
9. Warranty
The equipment installed by JoyTech Mechanical may be subject to manufacturer’s warranties. Any warranty claims related to the equipment will be subject to the terms and conditions set forth by the manufacturer. JoyTech Mechanical provides a 1-year warranty on labor related to the installation. This warranty does not cover misuse, negligence, or damages caused by the customer or third-party contractors. JoyTech Mechanical reserves the right to inspect the installation and determine the cause of defect before honoring the warranty claim.
10. Communication Consent

11. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York. Any disputes arising from or related to these Terms and Conditions shall be resolved in the courts located within New York.
12. Entire Agreement
These Terms and Conditions, along with the signed proposal, constitute the entire agreement between the customer and JoyTech Mechanical. No oral representations or statements made by any party shall be binding unless confirmed in writing and signed by both parties.
13. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
